Member Regulations

DEFINITIONS

These member regulations describe the conditions and obligations attached to membership. They include, among other things, the house rules and the registration and payment terms. The following definitions apply in these regulations.

  • VBSK: the Vereniging tot Bescherming van het Schoolkind Albert Cuyp, established at Albert Cuypstraat 241, 1073 BH Amsterdam;
  • Boxing School VBSK Albert Cuyp: the concept, the various activities, and the accommodation used for them at Albert Cuypstraat 241, 1073 BH Amsterdam;
  • Manager: the person responsible for managing the facilities;
  • Trainer: the person who provides training on behalf of VBSK;
  • Participant: a natural person of any gender who takes part in activities at Boxing School VBSK Albert Cuyp and in whose name the membership is administered;
  • Membership fee: the amount owed by the participant to VBSK for the duration of the membership.

ARTICLE 1: REGISTRATION AND ACCESS

  • Registration for Boxing School VBSK Albert Cuyp takes place by fully completing the registration form on the website and sending it to VBSK.
  • Membership and the payment obligation start at the moment VBSK receives the registration form. Participation in the activities of Boxing School VBSK Albert Cuyp and the direct debit by VBSK start on the date indicated on the registration form, subject to the provisions of Article 2(c).
  • Waiting list: if the maximum number of participants for a class has been reached, the participant may be placed on a waiting list. This happens when there are more registrations than available places. The participant will be informed by VBSK as soon as the membership can commence.
  • Persons between the ages of 14 and 18 may also train at Boxing School VBSK Albert Cuyp. However, registration and payment of the membership must be completed by a parent or guardian; see also Article 3.

ARTICLE 2: MEMBERSHIP, TERM AND PAYMENT

  • A VBSK membership applies from the start date. The membership is automatically renewed each time for the same period, unless the participant has indicated that they do not wish to renew it. The membership start date is the moment the registration is submitted via the website.
  • All membership fees are due and payable in advance. Payment is made by direct debit.
  • If the amount owed to VBSK cannot be collected, for example due to insufficient funds or for any other reason, the direct debit will be submitted again. If the transfer fails for any reason a second time, the membership will be blocked.
  • A membership remains blocked until the payment obligation has been fulfilled. The participant will also be denied access to VBSK and Boxing School VBSK Albert Cuyp activities. In the event of payment arrears, VBSK is entitled to terminate the relationship with the participant without the payment obligation lapsing.
  • Membership fee increases may be implemented once per year, for example as a result of government measures, such as a change in the VAT rate, or changed location and accommodation costs. Participants will be informed no later than two months before a subscription price change is activated. This may be done by email, letter, or digital newsletter. If a participant does not agree to the fee adjustment, they may terminate the membership subject to the regular notice period. If the participant or their parent or guardian does not respond, the fee adjustment will be deemed accepted.
  • Membership fees are never refundable. In the event of injuries or long-term illness, the membership may be paused; see Article 8.
  • If the participant does not make use of activities for which they are registered, no refund of the membership fee will be given.
  • When VBSK does not offer classes due to school holidays, the temporary closure of the boxing school for renovation work, government measures, or other external circumstances, missed classes cannot be made up.
  • There is no credit system or concept of a class being owed for missed classes.

ARTICLE 3: YOUTH AND YOUNG ADULT MEMBERSHIP

  • Youth members aged 14 to 18 and young adults aged 18 to 24 may participate in sports at VBSK at a reduced membership fee.
  • From the age of 14, young people may participate in the regular classes.
  • Parents or guardians of persons under the age of 18 are responsible for the registration and payment of that participant's membership.

ARTICLE 4: TERMINATION OF MEMBERSHIP

  • Termination of a membership by the participant, regardless of the reason, must be done in writing by sending an email to our member administration. The postal address and email address of our member administration can be found on our website. A verbal cancellation is not sufficient.
  • Notice of termination must be received by the VBSK member administration at least one month before the membership end date.
  • If notice is not given in time, the membership will be automatically renewed for the same period as the previous term.
  • Upon termination, VBSK will send a confirmation by email. If no such confirmation is received, the termination has not been properly processed.
  • VBSK reserves the right, in the event of serious or repeated breaches of these regulations, the house rules, or other proven unacceptable behaviour, to terminate a membership without refund of any payment and without cancellation of the payment obligation for the current contract term.

ARTICLE 5: VBSK MEMBERSHIP

  • A VBSK membership is entered into for a period of one full year, unless otherwise agreed with VBSK.
  • Membership is strictly personal and may not be transferred to another person, unless otherwise agreed in writing with VBSK.

ARTICLE 6: ANNUAL SCHEDULE

  • VBSK class schedules and class times are variable. VBSK reserves the right to change the layout of, among other things, location, day, time, and programme. These changes will be communicated to members as soon as possible.
  • In the event of a trainer being absent due to illness or other circumstances, VBSK reserves the right to cancel a training session or replace it with another class. VBSK will make every effort to arrange a substitute trainer.
  • VBSK reserves the right to adjust the schedule during school holiday periods.
  • VBSK is closed on the days listed below. No training sessions are offered on those days.
  • Easter weekend: Good Friday through Easter Monday
    King's Day
    Ascension Day
    Pentecost: Whit Sunday and Whit Monday
    Summer holiday: from 1 July through 31 August there is an adjusted summer schedule.
    Christmas holiday: from 24 December through 1 January the school is closed.

ARTICLE 7: RISK AND LIABILITY

  • Participation in sports and exercise activities involves risks. Taking part in activities that form part of VBSK is entirely at the participant's own risk.
  • Neither VBSK, the trainer, nor the manager of the training facility accepts any liability for material or immaterial damage resulting from any accident or injury suffered by the participant.
  • The participant shall indemnify both VBSK and the facility manager against claims by third parties in this respect.
  • Neither VBSK, the trainer, nor the manager of the facility accepts any liability for damage to, loss of, or theft of the participant's property.
  • If VBSK is required for any reason to pay compensation, such compensation shall not exceed the amount paid out in the relevant case under VBSK's liability insurance.
  • If a participant irreparably damages property or materials belonging to VBSK, the trainer, or the manager, the participant will be held liable for all resulting costs.

ARTICLE 8: ILLNESS, INJURIES, PREGNANCY AND DEATH

  • If, for a period longer than six weeks, the participant is unable to take part in VBSK activities due to illness, injury, or pregnancy, the membership may be temporarily paused for a maximum of three months. This is only possible upon presentation of proof from a general practitioner or physiotherapist describing the complaint.
  • In the case of long-term injuries, the participant may cancel their membership via the normal procedure. No refund of the membership fee will be given.
  • During pregnancy, the participant may often continue training for a long time under the guidance of the trainer and VBSK. If the participant no longer wishes to take part in VBSK activities, they may cancel the membership via the normal procedure. No refund of the membership fee will be given.
  • If the participant dies, all mutual obligations between the participant and VBSK shall lapse. VBSK must be informed of the death without delay.
  • No refund of the membership fee is possible.

ARTICLE 9: COMPLAINTS AND HOUSE RULES

  • In the event of complaints relating to VBSK and Boxing School VBSK Albert Cuyp, the participant must first contact VBSK.
  • Upon registration, the participant is deemed to be aware of these member regulations and to act accordingly. The participant also signs for this on the registration form.
  • Participants of Boxing School VBSK Albert Cuyp each have their own sporting goals for attending training. To make every visit enjoyable for everyone, VBSK has drawn up house rules. These VBSK house rules form an integral part of these member regulations and can be read on our website at `vbsk.nl/house-rules`.

ARTICLE 10: APPLICABLE LAW AND DISPUTES

  • These conditions and all agreements entered into by or with VBSK are governed exclusively by Dutch law.
  • Any disputes arising from the agreement between the participant and VBSK shall be settled by the court that has jurisdiction under the law or the applicable international treaty in the district where VBSK is established.

ARTICLE 11: FINAL PROVISIONS

  • By registering, the participant declares that they accept the registration and payment terms, the provisions of these general conditions, and the house rules of VBSK.
  • These conditions govern the legal relationship between VBSK and the participant.
  • This version of the general conditions replaces any previous versions.
  • If it is established that any provision of the general conditions cannot be relied upon, that provision shall, in terms of content and intent, be given a meaning that corresponds as closely as possible to the original. The validity or invalidity of one specific provision does not affect the validity of the remaining provisions.
